The prospect of a mesothelioma lawsuit can seem intimidating in and of itself, therefore this article is intended to assuage any fears about mesothelioma litigation by provide answers to questions commonly asked about mesothelioma lawsuits.. In order to properly deal with this condition, it is important to address the medical treatment of the mesothelioma first. What does the term “occupational exposure” mean in the context of a mesothelioma lawsuit?

If you worked with asbestos and then contracted mesothelioma, even if it was years after the exposure, you experienced occupational exposure. “Occupational exposure” means that you were exposed to the agent that caused your mesothelioma – usually the toxic mineral asbestos in its insulation and fireproofing forms. If the lawyer determines that your case is sound and will probably recover some monetary compensation and damages, he will then file a complaint and summons suing the appropriate parties for the exposure leading up to mesothelioma.Litigation is a long and confusing process. When you contact a lawyer about a potential mesothelioma claim, present your medical records and diagnosis.

The other side will probably request your medical records, as well, in order to determine if you had a pre-existing condition or other medical problems that may relieve them of responsibility for your occupational mesothelioma. Since mesothelioma is a disease, an Independent Medical Examiner (IME) will conduct an unbiased medical investigation into your mesothelioma and examine your medical records. The court will set a series of dates for discovery and trial and, if the case does not settle, both parties will begin to work towards building a case.

If your case goes to trial, expect your lawyer to consult with other experts, a trial preparation specialist, multimedia experts who can help present the evidence at trial in the most convincing manner, and witnesses who can bolster your own testimony in your mesothelioma trial. In an effort to avoid the cost and expense of a lengthy jury trial, many states require a mandatory settlement conference (MSC) or arbitration at which both parties sit down for a last-ditch attempt to resolve your complaints. Do patients usually win mesothelioma lawsuits?

It may seem like a daunting process, but patients do effectively fight and win against employers who have caused them to be exposed to toxic asbestos and its devastating health effects. Often, employers knew of the health dangers of asbestos but did not warn their workers or enable them to work in safe conditions.

A recent study conducted on workers in a US Coast Guard shipyard has found a significantly greater mortality rate associated with lung cancer and mesothelioma compared to the general population. The study also found an increased general mortality rate.

The study followed 4702 (4413 men and 289 women) civilian workers who were employed at the shipyard between January 1950 and December 1964. The study then measured the number of deaths and their causes through 31 December 2001.

The study was conducted by S Krstev, P Stewart, J Rusiecki, A Blair and was published in Occupational and Environmental Medicine. The original study publication is available at http://oem.bmj.com/cgi/content/abstract/64/10/651.

Mesothelioma is a form of cancer that is usually associated with exposure to asbestos. The majority of individuals who are diagnosed with mesothelioma have a history of exposure to asbestos particles at work or home. Family members of workers have also been affected. Renovators of homes containing asbestos cement material are accounting for an increasing number of diagnosed sufferers. Symptoms of mesothelioma may not appear for decades after the exposure to asbestos. Symptoms include abdominal pain and weight loss. Diagnosis of mesothelioma can be difficult due to the fact that the symptoms are similar to other respiratory diseases.

Since mesothelioma is primarily caused by exposure to asbestos, mesothelioma can be best be prevented by avoiding or limiting exposure to asbestos in homes, public buildings, and at work. Workers that may be at risk include miners, factory workers, insulation manufacturers, railroad workers, ship builders, contractors and construction workers, particularly those involved with insulation. If there is a possibility of exposure (such as when renovating old buildings) protective equipment should be used and safety procedures should be applied. Asbestos was commonly used in building materials due to its durability and fire-resistant properties. In addition to buildings, asbestos was used in the manufacture of cars and ships and many other products.

Mesothelioma is a kind of cancer the affects the mesothelium which is a protective cover for many internal organs including the intestines, heart, lungs and others. The disease is associated with asbestos and majority of all cases have come into contact with the substance either through contact or inhaling it. When a factory worker handles asbestos, he risks exposing it to his family and therefore it becomes a very serious issue when so many people have to suffer. This is one of the cancer that affects the lungs and is not associated with smoking. Generally, the disease is quite rare and in the United States, only 2,000 cases are diagnosed annually and the disease is more common in men than in women. It has been found that you can be exposed to asbestos and 30 or 50 years later, will be when you start experiencing the symptoms of the disease.

Therefore, the major risk factor to getting mesothelioma is working near asbestos. If you have no idea what asbestos is, then you need to know that it is a name given to a group of minerals and they occur naturally. Their strong fibers can be woven because they are very flexible. They are used in industries to produce various products like roof shingles, brake linings, cement, flooring products, textiles and insulation. Many workers in this industry can inhale the fibers and some may be trapped in their cloths. When the disease had not been discovered, many people used to suffer and they all seemed to work in the asbestos mining industry. When the cause was established, safety measures were put in place and workers in the U.S wear personal protective equipment and are only exposed to acceptable amounts of asbestos.

Workers also take other safety measures like showering and changing cloths before they leave their work areas. This enables them to reduce the risk of exposing the asbestos to their families. The symptoms of mesothelioma vary from the specific organs they affect and in the chest, you will experience shortness of breathe and intense pain. In the abdomen, you will have bowel obstruction, blood clotting, anemia, lack of appetite and weight loss. There will be a host of other symptoms like swelling of the face and trouble while swallowing. You are advised not to hesitate but, to see a specialist who will make recommendations for treatment if you are suffering from a form of mesothelioma.

Once you visit the doctor, he will do a test for mesothelioma and it is one of the most difficult tests to do. Very many diseases have similar symptoms and this is the reason why it is so hard to diagnose. Your history will provide the major clue as to whether, you have had asbestos exposure. A series of x rays will be performed as well as a host of other examinations. A biopsy will determine whether the cells are noncancerous in your body and if they are cancerous, you will be advised on the way forward. There are many treatment options available and you can recover completely from this disease. The options are surgery, radiation, chemotherapy and others which have not been approved.

Treatments for mesothelioma depends on the stage of the cancer, the specific part being affected, the total amount of space being affected, how long one have the problem of mesothelioma, the look of the cancer cells under microscope and the age factor of the patient. These are the factors that are being considered before choosing the treatment option.

Treatments for mesothelioma include Surgery, Chemotherapy and Radiation Therapy.

Surgery : There are two types of surgery available one is aggressive surgery and another one is called palliative procedures.

Aggressive surgery is done through a procedure named extra pleural pneumonectomy, by which the pleura, the lung, the diaphragm and the pericardium are removed. The aggressive surgery’s motive is to remove as much tumor as possible.

Palliative procedures will be done when the mesothelioma disease is at the matured stage. The motive of this procedure is to give relief to the patient from the symptoms.

Chemotherapy : In chemotherapy drugs are being used to treat mesothelioma cancer. The drugs may be in the form of pills or injections. To improve the results of the chemotherapy some drugs may be used as mix in some proportion and this has given a good improvement in the treatment results.

Radiation therapy : Radiation therapy uses radiations to kill mesothelioma tumor. This procedure is complex to undergo as the tumors are surrounded by sensitive parts of our body. There are possibilities that the heart and lungs being damaged by the radiation. Lower dose radiation is one solution to slightly overcome from this critical issue.

Persistent diseases like lung cancer and mesothelioma was extremely common in construction workers who were exposed to asbestos fibers or dust, doctors began making a connection between asbestos and mesothelioma. Shipping, construction and other workers, who were exposed to asbestos from the 1950s to the 1970s, when the dangers of asbestos was being recognized, are still suffering from the ill effects of asbestos exposure at work. More and more cases of people working under asbestos were infected with mesothelioma. So, Asbestos was considered a cause of mesothelioma. Various laws and regulations are in place, which is designed to prevent workers from exposure to toxic asbestos.

Workers who may have been exposed to asbestos in the 1970s, they are showing the symptoms of mesothelioma now. The reason behind this is that mesothelioma is slow to manifest. Mesothelioma cannot be diagnosed during its early stages. Because its symptoms take too long to manifest and it is often mistaken with those of other diseases, mesothelioma can be mistaken as pneumonia or other diseases during its early stages. The symptoms of mesothelioma include shortness of breath, abdominal swelling, chest pain, chronic cough, fever, weight loss, etc.

Different laws and regulations have limited the use of asbestos; mesothelioma takes a long period to develop means that it still has a large number of probable victims. Professions with the risk for asbestos exposure and mesothelioma are those which involved repeated exposure to asbestos in its industrial forms. These professions could be electricians, construction workers, bricklayers, mechanics, insulators and people involved with commercial or home construction before the 1970s.The families of these workers or people were also at risk, since they may have inhaled asbestos through the employee’s clothing or hair.

As more and people are getting aware of mesothelioma and asbestos there has been a significant amount of increase in lawsuits against companies who irresponsibly used asbestos, exposing their employees to the threat of mesothelioma and other life-threatening asbestos-related illnesses. If you were exposed to asbestos at any period of time you can get yourself diagnosed for mesothelioma. A mesothelioma sufferer or his family can contact an asbestos attorney who is experienced in mesothelioma litigation. A mesothelioma lawyer will help the person recover damages for the pain and suffering incurred through asbestos exposure.

Although Mesothelioma is a term that is often heard broadcast over the television airways by soliciting attorneys it is nonetheless a condition which is not
well understood by the general public.

Mesothelioma is a type of cancer that can affect individuals who either work or have worked in asbestos manufacturing plants, automotive shops, mining, ship yards and constructions industries.

Mesothelioma Cancer is caused from exposure to the fibrous material strands known as asbestos. These fibers are resistant to heat and chemicals which makes it an ideal substance for such applications as roofs, home insulation, cement, etc. However, these same properties make it very difficult for the human body to get rid of them.

Mesothelioma has no gender or age barriers. Given the right set of circumstances children are at equal risk for developing this life-threatening disease.

Although it is true that children do not usually work with or around asbestos they may however, frequent older public buildings or schools where the asbestos material used in the ceilings and flooring has started to deteriorate, releasing small asbestos particles into the air. These particles can then be breathed into the lungs causing tissue scaring, excess fluid accumulation and breathing difficulties.

Children whose parents work with or around asbestos are at greater risk of developing asbestos-related diseases (asbestosis or mesothelioma) due to second-hand exposure (asbestos particles transported from work to home via clothing or hair.

One might ask, if it is true that children can develop asbestos-related conditions, why don’t we hear about them?

The reason is simple. Mesothelioma has a 30-50 year incubation period (time from exposure to the onset of the first major symptoms). A child that is exposed at age six will quite possibly not have significant symptoms until he/she becomes an adult of age 36.

This might explain why experts say that it is possible for some people to develop Mesothelioma even when there has been no known asbestos exposure.

Is it possible that this now adult individual had been exposed repeatedly as a child? This might also explain why there are so many children suffering with respiratory ailments today!

Although the United States government has established laws governing exposure limits, not all facilities comply. Abestos is still alive and well but there are things that can be done to reduce exposure risk:

1. When possible avoid old buildings that are in disrepair.

2. Check with school officials regarding asbestos safety implementation programs.

3. Be sure that anyone who lives in your home and works with or around asbestos strictly adheres to the OSHA safety rules regarding work clothes, showering before leaving the work place, etc.

4. Contact your doctor at the first sign of illness or to discuss any health concerns you might have.

Mesothelioma Treatment varies depending upon its location, stage and patient’s overall health.

The MESOMARK test signifies the beginning of a new era in monitoring mesothelioma malignancies,” said Dr. W. Jeffrey Allard, vice president and chief scientific officer of Fujirebio Diagnostics. “As the first in-vitro test for patients with this aggressive disease, it will enable doctors to more accurately detect recurrence and monitor treatment of patients.”
The MESOMARK Assay test kit was developed to measure levels of a biomarker, mesothelin, in serum. Biomarkers are substances found in higher-than-normal concentrations in the blood, urine or body tissues of patients with certain types of cancers. The test may be used to monitor patients confirmed as having mesothelioma, for recurrence in patients following surgery, or for measuring response to therapies.
“Current diagnostic tests are less than ideal for quantification of changes in tumor volume, which is key to managing the disease,” continued Allard. “As the MESOMARK results correlate with tumor volume*, it provides a much needed tool for monitoring patient status. It is our plan to collect additional data in the future to support the use of the test to detect mesothelioma.”

MESOMARK test are now making it possible – with a simple blood test -to monitor response to treatment and to detect recurrence following treatment. This provides an important head start to patients racing against this aggressive cancer. “The Meso Foundation is the national research funding, patient support and advocacy organization dedicated to eradicating mesothelioma as a life-threatening disease.
Those wishing to take part in MESOMARK testing will be asked to provide one or more samples of blood. The blood samples will then be sent to a national reference laboratory for testing. In conjunction with other clinical and laboratory data obtained by your doctor, decisions regarding your treatment and care may be simplified. You may discontinue testing at any time.

Mesothelioma is known to be produced by exposing yourself to asbestos during a long period of time. A period of time hundreds and thousands of mine and shipyard workers are exposed while they work hard. The first case of mesothelioma ever to be linked with asbestos remotes as early as the 1890s. Almost a full century passed until the first mesothelioma lawsuit was filed against asbestos manufacturers in the US.

Information Denial

Mesothelioma information and asbestos cancer information was practically refrained from workers causing them to get infected throughout the years without even knowing what was mesothelioma. Some asbestos producing companies even sent out memos about abstaining to inform their workers about the illness until they were already infected with mesothelioma.

It is no wonder why there are some many people now a day with pleural and peritoneal mesothelioma. Pleural mesothelioma affects the lungs tissue, while peritoneal mesothelioma affects the abdomen.

Mesothelioma Treatments

There is no known cure to mesothelioma cancer but doctors and scientists are making a huge effort to try and finding it. Currently there are various mesothelioma treatments but don’t ultimately cure it.

Mesothelioma is a serious disease and serious attempt should be made to inform the American people about what is going on. Mesothelioma lawsuits have been filed and won by thousands of people infected. With the right mesothelioma information, asbestos manufactures shouldn’t have to pay billions in compensation for mesothelioma infected workers.

Preventable Crisis

This is an illness that can be 100% preventable and many companies knew that. The only thing is that they were too busy focusing in making billions out of blood money that they forgot to care about their workers.

Mesothelioma is very fast approaching the proportions that have been unheard of in the near past. Every year thousands of new cases of mesothelioma are reported all over the world. Thousands have already succumbed to this deadly cancer. Many more are already battling this deadly cancer. More important than anything else is the fact that the major cause of this cancer is exposure to asbestos. This mineral was used quite extensively in many applications across the world. As a result millions of people were exposed to this dangerous mineral. The startling fact about the cancer of meothelioma is that the governments as well as the businesses involved with asbestos were aware of the potential dangers of working with asbestos. Yet neither did they inform the workers nor did they stop the use of this mineral. As a result the cancer of Mesothelioma is now very fast becoming one of the most deadly cancers in the world.
It is time that the various governments and other health organizations wake up to the harsh reality and stop the use and production of asbestos all across the globe. The developed nations of the world which were the worst affected by this cancer in the last century have realized this and have already placed a ban on asbestos. The developing nations somehow have still not realized the dangers of working with asbestos. A particular study has revealed that the developing nations are going to be afflicted with this cancer in a much dangerous way than the developed countries did. It is time that the governments of these nations learn from the mistakes of the developed nations. The governments of developed nations also need to assist the developing countries in fighting this cancer. A big portion of investment is needed from both the governments as well as private bodies in the field of research to find a permanent treatment of this cancer.
